Default iPhone 3GS and O2

Like other 3G owners, I'm facing the problem of either paying over £300 to end my contract early or waiting until at least Christmas to get a 3GS. This is further complicated by the fact that I got my 2G from O2 and then my 3G via Carphone Warehouse so my online account isn't correct (I originally thought I'd be able to get away with getting a 3GS on 17th June). Fortunately, O2 is allowing MMS under the same conditions as their other contracts - 1 MMS uses up 4 messages out of your monthly allowance and once you've reached your monthly limit, you get charged the same as anyone else.

Tethering, on the other hand, is proving to be a rather bitter pill for some O2 customers. In theory, all iPhone contracts have unlimited data but the small print talks about a "fair usage" policy (without saying what that entails). They will allow tethering on the iPhone but only if we buy "data bolt-ons" at a minimum cost of £15 (about $23) a month so our data is definitely not unlimited!

While I have a certain amount of technical knowledge, I don't know how they can tell the difference between connecting directly from the phone or using it as a modem. Maybe it's something really obvious but if anyone can enlighten me, I'd be very grateful.
